Real Estate Financial Modeling LLC (“REFM,” “we,” or “us”) respects your privacy. This Privacy Policy explains how REFM collects, uses and safeguards information on its internet properties, including, without limitation, www.getrefm.com, subdomains of www.getrefm.com, mobile websites, microsites, mobile applications, REFM profiles on social media sites and any other digital services and properties officially operated or used by REFM from time to time (collectively, the “Site” or “Services”).
This Privacy Policy together with the Terms of Use and any legal notices that may be provided by REFM during the term of these Terms are integral parts of the agreement between you and us concerning the use of the Site. All capitalized terms used herein that are not otherwise defined in this Privacy Policy shall be as defined in the Terms of Service.
I. Changes to the Privacy Policy
As REFM products and services change from time to time, this Privacy Policy is expected to change as well. We reserve the right to amend the Privacy Policy at any time, for any reason. The date of the last revision to the Privacy Policy will be indicated by the “Last Updated” date at the beginning of this page.
II. Children
The Site is intended for general audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information without parental consent, please contact us at [email protected]. If we become aware that a child under 13 has provided us with personal information without parental consent, we take steps to remove such information and terminate the account.
III. Information You Submit
We store the information you submit to or through the Site. We use the information to fulfill your requests, provide Services to you, provide Site functionality, improve Site quality, personalize your experience, provide customer support, message you, back-up our systems, allow for disaster recovery, and comply with legal obligations. Among the information you submit to or through the Site, please note:
1. Account Registration: You must provide a valid email address in order to sign up for an Account on the Site. In addition, you may provide us with your full name, email address, location, and preferred username, and password. When you sign up for an Account we, by default, opt you in to receive emails from REFM. Note that you cannot opt out of receiving required administrative or legal notices. You are solely responsible for any and all activities that occur under or in connection with Your Account. You agree to be responsible for any act or omission of any users accessing the Site under Your Account, that, if undertaken by you, would be deemed a violation of this Policy, and that such act or omission shall be deemed a violation by you. Please notify us immediately if you become aware that Your Account is being used without authorization. You agree not to register for an Account on behalf of an individual other than yourself, or register for an Account on behalf of any group or entity unless you are authorized to bind such person, group or entity. By registering another person, group or entity you hereby represent that you are authorized to do so.
2.Content: Your Content (which includes your comments, posts, uploads, charts, comments, information, reviews, tips, photos, message board posts, bookmarks, lists, account profile – including your username, first and last name, but excluding your other account registration information) – and other information you post to the Site (other than information submitted by you to the Site for purposes of transaction analysis and marketing utilizing the Services) are meant for public consumption. We may display this Content on the Site, and may further distribute it to a wider audience through third party sites and services with whom we are affiliated or have contracted.
3.Messaging: If REFM extends functionality allowing You to exchange messages with others through the Site, we may store these messages in order to deliver them and allow you to manage them. If you send information from the Site to your phone via SMS text message, we may log your phone number, phone carrier, and the date and time that the message was processed. Mobile phone carriers may charge recipients for texts that they receive.
4.Payment Information: Access to some features of the Site is available without charge. However, certain Services are subject to charges. When we collect payment information directly from You, like credit card numbers (collectively, “Payment Information”), we do not disclose that information to any third party except for purposes of processing payments for Services that you elect to purchase and we encrypt that information using industry standard technology.

IV. Information We Collect
In addition to the information you submit to or through the Site, we also collect and store information from and about you that may not be personally identifiable (“Non Personal Data”), in the course of your use of the Site. We use this information to analyze and track user behavior on the Site, personalize your experience, provide the functionality and improve the quality of the Site, and monitor real estate financial transaction analysis and marketing activity on an anonymous basis. For example:
1.Location: We may collect and store information about your location if you enable your computer or device to send us location information. You may be able to change the settings on your computer or device to prevent it from providing us with such information.
2.Activity: We may collect and store information related to you and your use of the Site, such as but not limited to your browser type, IP address, unique device identifier, the phone numbers and names of businesses where you use our services through the Site, requested URL, referring URL, browser language, the pages and content you view, and the date and time of your visit.
3.Cookies: We may use cookies, web beacons, local shared objects (sometimes called “flash cookies”), and similar technology in connection with your use of the Site (“Cookies”). Cookies may have unique identifiers, and reside, among other places, on your computer, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Site, such as your browser type, search preferences, and the date and time of your use. You can disable some (but not all) Cookies in your device or browser settings, but doing so may affect your ability to use some or all of the Site’s features.
4.Third Party Services: REFM may use third party application tracking services like Google Analytics to help understand the use of our Services and Site. Please be aware that through Google Analytics the information sent by your browser as part of a web page request, including cookies and your IP address, is collected. In that case, Google will also receive this information and their use of it is governed by their Privacy Policy.
V. What we do with the information and Third Parties
We do not rent, share, sell or trade personally identifiable information with third parties for their direct marketing purposes. That said, we work with third parties and they may have access to some of your information:
1.Service Providers: We may outsource some of our technical and customer support, tracking and reporting functions, quality assurance testing, payment processing functions, and other services to third parties. We may share information from or about you with them so that they can perform their services.
2.Aggregate Information: We may share user information in the aggregate (i.e. non identifiable) with third parties, such as content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, certain type of content.
3.Business Transfers: We may share information from or about you with subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires REFM or all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
4.Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is (a) reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) helpful to prevent, investigate, or identify possible wrongdoing in connection with the Site; or (c) protect our rights, reputation, property, or that of our users, affiliates, or the public.
5.Links: The Site may contain links to unaffiliated third party websites. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices. We suggest you read the privacy policies on all such third party websites.
VI. Controlling Your Personal Data
You can manage your account profile and email preferences, including opting out of email either online or by contacting us at [email protected].
Please be aware that other users may be able to identify you, or associate you with Your Account if you include Personal Information in your Content.
Please also note that the messages you send or receive using the Site are only private to the extent that you and the sender/recipient keep them private. For example, we do not have any control over whether a recipient of one of your personal messages publicly posts the message or its contents.
VII. Data Retention and Account Termination
The information we obtain from or about you may be processed and stored in the United States of America. We may keep it as long as is permitted or required under the law. If you terminate your account, we may remove your Content from the Site, but may retain your data for a period of five (5) years (or longer if required by law) in our active systems in order to ensure our ability to satisfy the authorized uses under this Privacy Policy. For example, we may use retained data to prevent, investigate, or identify possible wrongdoing in connection with the Site or to comply with legal obligations. Please note that information may exist in backup storage even after it has been removed from our active databases. You can request that Your Account be terminated by emailing [email protected]. When logged into your account, you can remove or edit Content that you have uploaded to the Site by clicking on the respective links.
VIII. Your California Privacy Rights. Under California Civil Code Section 1798.83 (known as the “Shine the Light” law) we hereby notify you that we do not share your personal information for third-party direct marketing use unless you affirmatively opted in to such sharing.
IX. Security
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet or via device, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

XI. Modifications to This Privacy Policy
We may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your information going forward. If we make material changes to this Privacy Policy, we will notify you by email or by posting a notice on the Site prior to the effective date of the changes. By continuing to access or use the Site after those changes become effective, you agree to be bound by the revised Privacy Policy.
